General terms and conditions

This is a project of Rose & Rose with Mr Roland Rose being the proprietor. The address is: Rudolstädter Str. 98, 10713 Berlin, Germany. On this portal Rose & Rose receives advertisement orders from costumers to be published on the internet. For the procedure of such an advertisement order the following general terms and conditions apply.

Placing of order
For the advertiser the options Online/Mail/Fax are available to place an order concerning advertisments of different kinds (according to the offers on our portal). With the placing of the advertisement order the customer accepts these general terms and conditions.

Order acceptance
There is no legal claim for an advertisement at our web site. After receiving the advertisement, it will be checked by Rose & Rose. If it will be accepted the customer will get the bill in written form.

Settlement of order
The order becomes legally valid with receipt of payment and the customer thus acknowledges the general terms and conditions. Both parties may cancel the order before receipt of payment without having to give reasons. A simple message is sufficient.

Early termination / prolongation of an advertisement order
The advertisment order becomes legally valid with receipt of payment at Rose & Rose and it starts with the date of the placement of the advertisement at the internet site. If an advertisment order shall be terminated early, Rose & Rose have to be informed in written form. A complete or partial reimbursement of the amount paid is impossible.

Rights of third party
With regards to the advertisment orders Rose & Rose assumes that the content does not violate existing law. Rose & Rose is not obliged to check these conditions. Should a violation against existing law or the rights of a third party occur, the customer releases Rose & Rose from all claims of a third party.

Exclusion of liability
Rose & Rose is not liable for placing advertisments at certain positions or at certain dates and Rose & Rose is reserving explicitly for itself the right to change or replenish parts of the internet site or to change or replenish the whole site without extra notice, or to stop its publication on the net temporarily or completely. In the case of a stop of the publication the customer will get back the propotionate amount in terms of money. Any complaints are to be expressed in written form immediately after the customer gets knowledge of the defect. The compensation for damages in case of gross negligence by Rose & Rose is limited to the amount of the payment made for the respective advertisment.

Data protection
Rose & Rose will save the data of the customer for the purpose of automated data processing. § 33 BDSG (German data protection law) is to be applied.
